Vue E-Code Terms & Conditions

The following terms & conditions apply in relation to Vue products and services that are provided by Vue Entertainment Limited through and in collaboration with Ello Group.

1.1 This page (together with the documents referred to on it) tells you or whoever you are buying products and services for (the member) the terms and conditions on which we (Ello Group Limited) supply Vue Entertainment Limited (VEL) and Vue Services Limited (Vue)products and services. These terms and conditions are between us (ELLO Group Limited) and you. To the extent that you have any queries or complaints in respect of these terms and conditions, please contact us and not Vue.

1.2 Taste Marketing Limited is owned and operated by Ello Group Limited and further details regarding Ello Group Limited can be found on our website: www.ellogroup.co.uk/. 

1.3 You should retain a copy of these terms and conditions for future reference.

1.4 Please understand that if you refuse to accept these terms and conditions you will not be able to continue with the service.

1.5 We reserve the right to amend these terms and conditions at any time by giving you notice by posting the amended terms and conditions on our site. However, please note that you will be subject to the terms and conditions in force at the time of acceptance, unless any change to these terms and conditions is required to be made by law or governmental authority (in which case it will apply to orders previously placed by you).

1.6 If you sign-up for one of our products or services or otherwise engage with us, we will collect and use your personal data. 1.7 We may also share your personal data with VEL and Vue and other service providers engaged by VEL and Vue, as well as within the Ello Group of companies:

1.7.1 For the purposes of fulfilling any query that you have in relation to those products and services;

1.7.2 To ensure that products and services continue to be made available to you if we no longer collaborate with VEL and Vue to provide you with these products and services;

1.7.3 For the purposes of sending you marketing communications about VEL and Vue products and services using consent or legitimate interest where there is a lawful right to do so. 

1.7.4 or the purposes of sending you marketing communications about Ello Group products and services using consent or legitimate interest where there is a lawful right to do so.

2.1 The services are operated by the Ello Group Limited group of companies comprising of the following;

2.1.1 tastecard and coffee club is owned and operated by Taste Marketing Ltd, a company registered in England and Wales under company number 05545626 and with its registered office at Birkby Grange, 85 Birkby Hall Road, Birkby, Huddersfield, HD2 2XB. The VAT number is 220 9026 46.

2.1.2 Gourmet Society is owned and operated by Simard Limited, a company registered in England and Wales under company number 06655278 with its registered office at Birkby Grange, 85 Birkby Hall Road, Birkby, Huddersfield, HD2 2XB. The VAT number is 220 9026 46.

2.1.3 hi-life is owned and operated by hi-life Diners Club Limited, a company registered in England and Wales under company number 03940640 with its registered office at Birkby Grange, 85 Birkby Hall Road, Birkby, Huddersfield HD2 2XB. The VAT number is 220 9026 46.

3.1 By registering you warrant that you are legally capable of entering into binding contracts and you are at least 16 years old.

3.2 By purchasing a product where film classifications apply, you are doing so understanding the restrictions applicable to that film classification.

4.1 The contract between us will only be formed when you accept the terms and conditions. This acceptance confirms you agree to go ahead with the service.

4.2 You may have been provided access to the service by a third party and you therefore need to activate your service before you can use it. Please follow the instructions provided to you on the registration page sent via email.

5.1 Where the third party providing access to the product is your employer (either directly or indirectly), applications may be subject to approval from such third party before being issued and may be cancelled if salary deduction is not possible.

6.1 The price of the service will be as quoted, except in cases of obvious error.

6.2 Prices include VAT.

6.3 Prices are liable to change at any time, but changes will not affect orders in respect of which we have already sent you confirmation.

6.4 Payment must be by credit or debit card, or by such other method as we may agree from time to time. We will charge your credit or debit card when your order is placed.

7.1 Subject to clause 9.3, if we fail to comply with these terms and conditions, our liability to you will be limited to the purchase value.

7.2 Subject to clause 9.3, we will not be liable for losses that result from our failure to comply with these terms and conditions that fall into the following categories:

7.2.1 Loss of income or revenue;

7.2.2 Loss of business;

7.2.3 Loss of profits; or

7.2.4 Loss of anticipated savings.

7.3 Nothing in this agreement excludes or limits our liability for:

7.3.1 Death or personal injury caused by our negligence;

7.3.2 Fraud or fraudulent misrepresentation;

7.3.3 any breach of the obligations implied by section 12 of the Sale of Goods Act 1979 or section 2 of the Supply of Goods and Services Act 1982; or

7.3.4 Any other matter for which it would be illegal for us to exclude or attempt to exclude our liability.

7.4 Where you receive services from any third party, any losses or liability arising out of, or in connection with, such services shall be the relevant third party’s liability. We accept no liability for any bad experiences. We will not become involved in any dispute between you and venue.

9.5 We do not give any warranty for any goods or services accessed through, or displayed on, our site.

8.1 Applicable laws require that some of the information or communications we send to you should be in writing. When using our site, you accept that communication with us will be mainly electronic. We will contact you by e-mail or provide you with information by posting notices on our website (s). For contractual purposes, you agree to this electronic means of communication and you acknowledge that all contracts, notices, information and other communications that we provide to you electronically comply with any legal requirement that such communications be in writing. This condition does not affect your statutory rights.

9.1 Each e-code is valid for one admission ticket and must be used at
the time of exchange and cannot be exchanged for gift cards. E-codes can be
used online or at the Box Office.

9.2 E-codes are non-transferable,
non-exchangeable and non-refundable.

9.3 E-codes are valid for a single use only and cannot be reinstated or
replaced once redeemed (this includes if you cancel your booking).

9.4 Valid at any Vue location in the UK, including Vue West End
(Leicester Square).

9.5 Not valid for Premieres, Big Screen Events and alternative/special
showings including Mini Mornings, Senior friendly, Autism Friendly and Scene screenings.

9.6 Can be used to book VIP, Recliner, Xtreme seating or Gold class screenings online and at the Box Office at an additional upgrade fee. IMAX upgrades will also be at an additional cost and we recommend checking pricing directly with the cinema before purchase of Vue E-codes.

9.7 Upgrade to 3D are redeemable for entry into the screening only,
customers will be charged for the purchase of 3D glasses if required.

9.8 Purchase of the e-codes does not give priority over general tickets
or other visitors to Vue.

9.9 Expiry date and validity of your E-code(s) is outlined within your
confirmation email. These are not subject to any extensions.

9.10 Cannot be used in conjunction with any other offer including
Meerkat Movies.

9.11 Film classifications apply.

9.12 E-codes are not to be used for financial gain in resale.

9.13 The cinema managers decision is final.

Please note that due to Vue’s advance booking policy the film and
performance you wish to attend may be sold out and seats might not be
available.

10.1 Vouchers can be exchanged at the following Vue UK locations

10.2 These vouchers can be redeemed at your chosen Vue location only, not online or over the phone, on the day of the film showing.

10.3 The 20% food and drinks retail discount voucher can be applied at till point to food and drink retail items including soft drinks (all sizes), popcorn (all sizes), nachos, hotdogs, confectionary, ice cream, hot drinks and pick and mix. Advertised Combo Packages (items can still be purchased individually), alcoholic beverages, non-consumable such as toys and 3D glasses are excluded from this offer. Current advertised Combo packages include: Big Screen Combos, Snack it trays, Kids Trays and KitKat & Coffee combo.

10.4 Non-transferable, non-exchangeable and non-refundable.

10.5 Valid for a single use only and cannot be re-instated or replaced once redeemed (this includes if you cancel your booking).

10.6 Expiry date and validity of your E-code(s) is outlined within your confirmation email. These are not subject to any extensions.

10.7 Cannot be used in conjunction with any other offer.

10.8 Vouchers are not to be used for financial gain in resale.

10.9 The cinema manager’s decision is final.

Please note that due to Vue’s advance booking policy the film and performance you wish to attend may be sold out and seats might not be available.

11.1 All notices given by you to us must be given to the Chief Operations Director at info@ellomedia.com. We may give notice to you at either the e-mail or postal address you provide to us when placing an order, or in any of the ways specified in clause 15 above. Notice will be deemed received and properly served immediately when posted on our website, 24 hours after an e-mail is sent, or three days after the date of posting of any letter. In proving the service of any notice, it will be enough to prove, in the case of a letter, that such letter was properly addressed, stamped and placed in the post and, in the case of an e-mail, that such e-mail was sent to the specified e-mail address of the addressee.

12.1 Failure by us to enforce any of these terms and conditions will not prevent us from subsequently relying on, or enforcing, them.

13.1 If any court or competent authority decides that any of the provisions of these terms and conditions are invalid, unlawful or unenforceable to any extent, the term will, to that extent only, be severed from the remaining terms, which will continue to be valid to the fullest extent permitted by law.

14.1 A person who is not party to these terms and conditions shall not have any rights under or in connection with it under the Contracts (Rights of Third Parties) Act 1999.

15.1 These terms and conditions and any document expressly referred to in them constitute the whole agreement between us and supersede all previous discussions, correspondence, negotiations, previous arrangement, understanding or agreement between us relating to the subject matter of these terms and conditions. We each acknowledge that, in entering into these terms and conditions, neither of us relies on, or will have any remedies in respect of, any representation or warranty (whether made innocently or negligently) that is not set out in these terms and conditions or the documents referred to in them. Nothing in this clause limits or excludes any liability for fraud.

16.1 This agreement shall be interpreted in accordance with the English law and subject to the non-exclusive jurisdiction of the English Courts.
